What happens if I don't object within 20 days?
Under F.S. 61.13001, if you fail to file a timely objection, the court may presume the relocation is in the child's best interest. This makes it much harder to oppose the move later. Filing on time is critical.
What happens after I file the objection?
Once your objection is filed, the relocating parent cannot move until the court holds a hearing and rules. At the hearing, the relocating parent bears the burden of proving the move is in good faith and in the child's best interest.
What factors does the court consider?
The court considers factors including: the child's relationship with each parent, the child's age and needs, the feasibility of preserving the relationship with the non-relocating parent, the child's preference (if mature enough), and whether the relocation is made in good faith.
