About This Service
An optional add-on to your uncontested divorce. When your settlement gives one spouse the house, the divorce itself does not move the title — a deed does. We prepare the quitclaim deed from your prior recorded deed, coordinate the signing session with the remote online notary and the two witnesses Florida requires, and submit the deed for recording in the county where the property sits. The flat $500 attorney fee covers one deed for one parcel; county recording fees, any documentary stamp tax, and the notary fee are separate. Important: a quitclaim deed transfers ownership interest only — it does not remove either spouse from the mortgage, and it carries no warranty of title.

Common Questions
Does a quitclaim deed remove my spouse from the mortgage?
No. This is the most common misunderstanding about deeds in a divorce. A quitclaim deed transfers ownership interest only — it has no effect on the mortgage or the promissory note. If your spouse is on the loan, they stay on the loan until it is refinanced, formally assumed, or released by the lender. The divorce judgment can require one spouse to refinance, but the deed itself does not accomplish it.
Why isn't the deed included in the $750 divorce?
Because most uncontested divorces don't involve transferring real estate, and we'd rather not build that cost into everyone's flat fee. If your settlement does transfer a property, the deed is a separate document with its own drafting, execution, and recording steps — so it's offered as an optional $500 add-on for the clients who actually need it.
What does the $500 cover, and what costs extra?
The $500 is the flat attorney fee for one deed covering one parcel. Paid separately are the county recording fee, any documentary stamp tax that may be due on the transfer, the remote online notary fee, and a payment processing fee added at checkout. If your settlement transfers more than one property, each parcel needs its own deed.
Does a quitclaim deed guarantee the title is clear?
No. A quitclaim deed conveys whatever interest the signer has — if any — with no warranty of title. It does not certify that title is clear, that there are no liens, or that no one else has a claim. We do not perform a title search or issue title insurance as part of this service. If you need assurance about the state of title, a title company or a real estate attorney should examine it.
