Domestic Violence
Domestic violence in Florida means assault, battery, stalking, false imprisonment, or any criminal act causing physical injury or death by one family or household member against another. It can dramatically affect a divorce—courts must consider it when crafting a parenting plan and time-sharing, and a spouse can seek an injunction for protection (a restraining order). Legal Definition
As defined in F.S. §741.28, any assault, aggravated assault, battery, aggravated battery, sexual assault, sexual battery, stalking, kidnapping, false imprisonment, or any criminal offense resulting in physical injury or death of one family or household member by another; it is a mandatory factor in time-sharing determinations under F.S. §61.13.
